What is a prenuptial agreement?

A prenuptial (marriage) agreement (Family Code, Arts. 38–42) is a notarially certified contract between spouses defining their property rights and obligations during and upon dissolution of marriage. It may be concluded both before and during marriage. The agreement governs property relations only — personal rights, child custody, and legal capacity cannot be restricted (FC Art. 38.6). Notarial certification is mandatory.
