Maternity benefit is calculated based on the employee's average daily earnings over the last 12 months before going on maternity leave. According to Azerbaijan's legislation, maternity leave consists of 126 calendar days — 70 days before birth and 56 days after. In cases of multiple or complicated births, this period can be extended to 70+70 days. The benefit is paid at 100% of average daily earnings and is financed by DSMF. Maternity benefit is not subject to income tax.

How long is maternity leave?
In standard cases 126 calendar days — 70 before birth and 56 after. For multiple or complicated births, 70+70 days (140 days total) are granted.
What percentage is the maternity benefit?
Maternity benefit is paid at 100% of average daily earnings. Unlike sick leave, it does not depend on insurance experience.
Is maternity benefit taxed?
No. Maternity and birth benefit is completely exempt from income tax and DSMF contributions.
Can a self-employed woman receive maternity benefit?
Yes, if she has been making voluntary insurance contributions to DSMF. If no contributions were made, no benefit is paid.
How does maternity leave differ from childcare leave?
Maternity leave lasts 126 days and is paid at 100%. Childcare leave continues until the child reaches 3 years old, but the benefit during this period is significantly less.
