In Azerbaijan, child support amounts are calculated according to Articles 83-84 of the Family Code. Depending on the number of children, the following percentages apply: 25% of earnings for 1 child, 33% for 2 children, 50% for 3 or more children. Child support can be established either by voluntary agreement or by court order. If the debtor is unemployed or has unstable income, child support can also be set as a fixed amount. Child support payments are not subject to income tax.

Can child support be below the minimum wage?
No. Child support can never be below the minimum wage. If the calculated support is below the minimum, child support equal to the minimum wage is paid.
Does an unemployed person have to pay child support?
Yes. Unemployment does not eliminate the obligation to pay child support. When unemployed, child support is calculated based on the average monthly salary or set as a fixed amount.
When does child support payment end?
Child support is paid until the child reaches 18 years old. If the child is studying at a higher education institution, it can be extended to 23 years in some cases.
What liability applies to a person who doesn't pay child support?
Administrative fines, property seizure and in serious cases criminal liability can be applied to a person evading child support payments.
Does a voluntary child support agreement require notarial certification?
Yes. A voluntary child support payment agreement must be certified by a notary to have legal force.
